2. Scope
These Terms and Conditions apply to the sale of photographic prints ordered via puskasnori.hu between the Seller and the customer (Buyer). The language of the contract is the language of the order (Hungarian, English or German). The contract is not filed by the Seller and is not accessible later as a written contract; the Seller has not submitted to any code of conduct. The content of the contract consists of the order confirmation together with these Terms, which are attached to the confirmation email.
3. Products
The Seller sells prints of Nóra Puskás’s photographs: digital prints mounted on 5 mm PVC board, unframed, in colour or black and white. Sizes (width × height): portrait images 50 × 75 cm and 75 × 100 cm, landscape images 75 × 50 cm and 100 × 75 cm. Because the two sizes have different aspect ratios, the crop differs by size, as shown in the product page preview. Previews on the website are reduced in resolution and watermarked; prints carry no watermark. Colours of the print may differ slightly from what you see on screen due to display settings.
4. Prices
Prices are final prices in Hungarian forints (HUF): 50 × 75 cm and 75 × 50 cm – 25,000 Ft; 75 × 100 cm and 100 × 75 cm – 50,000 Ft. Colour and black-and-white versions cost the same. There is no delivery charge, as collection is in person only. In the case of an obviously incorrect price (e.g. 0 Ft) the Seller is not obliged to supply at that price; the Seller will offer the correct price or the Buyer may withdraw.
5. Ordering
On the product page of the chosen photograph, the Buyer selects size and version, enters name and email address (phone number optional), accepts these Terms, acknowledges the Privacy Notice and clicks “Place order with obligation to pay”. All details can be checked and corrected in the summary before sending. By clicking the button the Buyer makes an offer involving an obligation to pay.
6. Conclusion of the contract
The Seller confirms the order without delay by automatic email. The confirmation contains the order number, the photograph, size and version, the amount payable and the payment details; the contract is concluded with this confirmation. If the confirmation does not arrive within 48 hours, the Buyer is released from the offer. The confirmation is not an invoice and does not confirm payment.
7. Payment
The price can be paid via Revolut (revolut.me/puskasnori) or by bank transfer using the details in the confirmation. Please include the order number as the payment reference. Production starts once payment has been received. If payment is not received within a reasonable time, the Seller will contact the Buyer by email and, if this is unsuccessful, may cancel the order.
8. Performance and collection
The print will be ready within 7 working days of receipt of payment. Collection is in person only, at a place and time agreed with the Seller by email; delivery is not offered. Please check the print for damage on collection.
9. Right of withdrawal
Buyers who are consumers may, under Hungarian Government Decree 45/2014 (II. 26.), withdraw from the contract without giving reasons within 14 days of collecting the print; the right may also be exercised between the conclusion of the contract and collection. Withdrawal is made by an unequivocal statement: via the website’s Withdraw from contract function, by email to hello@puskasnori.hu, or using the model withdrawal form in Annex 2 of the Decree. The Seller confirms receipt of the withdrawal on a durable medium (by email). The Seller will refund the full amount paid within 14 days of being informed of the withdrawal, using the same payment method unless the Buyer expressly agrees otherwise. The Seller may withhold the refund until it has received the print back or the Buyer has proven that it has been returned. The Buyer must return the print in person or send it back at their own cost within 14 days of withdrawal. The Buyer is liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
10. Warranty
In the event of defective performance the Buyer may assert warranty claims under the Hungarian Civil Code: repair or replacement, or, if this is impossible or disproportionate, a price reduction or withdrawal. For consumer contracts, a defect discovered within one year of performance is presumed to have existed at the time of performance. Warranty claims lapse two years after performance. Defects must be reported without delay after discovery and at the latest within two months. Product liability claims can be asserted against the manufacturer. No mandatory guarantee applies to the prints.
11. Complaints and remedies
Complaints can be sent to hello@puskasnori.hu; the Seller will reply in writing with reasons within 30 days. In case of dispute, consumers may turn to the conciliation board competent for their place of residence or file a complaint with the consumer protection authority. Hungarian law applies to the contract; this does not affect the protection afforded to consumers by the mandatory provisions of the law of their country of residence.
12. Copyright
The photographs are copyright works of Nóra Puskás. Purchasing a print transfers ownership of the physical copy, not any right to use the photograph (e.g. reproduction or publication). Images published on the website may not be used without permission.
